1. Acceptance of Terms
By accessing or using The Web Radar platform, website, API, or any related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Service.
2. Description of Service
The Web Radar is a technology detection platform that crawls publicly available websites to identify the technology stacks used by companies. We provide this data through our website, dashboard, and API. The Service includes technology lookups, lead list generation, monitoring features, and API access.
3. Account Registration
To access certain features of the Service, you may need to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for safeguarding your account credentials and for all activities that occur under your account.
4. API Usage
Access to our API is governed by your subscription tier (Free, Pro, or Enterprise). Each tier has specific rate limits and usage quotas. You agree not to exceed these limits, circumvent rate limiting mechanisms, or use the API in a manner that degrades the Service for other users. API keys are confidential and must not be shared or exposed publicly.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Attempt to reverse-engineer, decompile, or disassemble any part of the Service
- Scrape, crawl, or otherwise extract data from the Service outside of the provided API
- Interfere with or disrupt the integrity or performance of the Service or its infrastructure
- Resell, redistribute, or sublicense access to the Service without authorization
- Use the Service to send spam, phishing, or unsolicited communications
6. Intellectual Property
The Service, including its design, features, content, and underlying technology, is owned by The Web Radar and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. Data retrieved through the Service may be used for your internal business purposes but may not be used to build a competing product or service.
7. Data Accuracy
While we strive to provide accurate technology detection results, the Service is provided on an “as-is” basis. Technology detection relies on publicly available signals, and results may not always be complete or current. We do not guarantee the accuracy, completeness, or timeliness of any data provided through the Service.
8. Payment and Billing
Paid subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable unless otherwise stated. We reserve the right to modify pricing with reasonable notice. Failure to pay may result in suspension or termination of your account.
9. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our sole discretion, with or without notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.
10. Limitation of Liability
To the maximum extent permitted by law, The Web Radar shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service. Our total liability shall not exceed the amount paid by you to The Web Radar in the twelve months preceding the claim.
11. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website and updating the “Last updated” date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
13. Governing Law
